Cooper. 

Apparently he had two beers and an energy drink.  Didnt take a breathalizer test but was arrested anyway. 1st offense..most likely will be dismissed.

  Most likely it won't be dismissed.  He didn't take a breathalyzer because he refused?  If they stopped him, arrested him, when they take you to the jail they make you breathalyze.  If not, you are guilty.  How do I know?  It happen to me when I lived in Texas and trust me, if he has a Texas drivers license, then he is fucked!!!  Been there and got the tshirt!  It isn't fun.

Yes, Texas license.  They asked him to give a blood test and take a breathalizer and he refused.  That is why they hauled him in.  Never took a test of anykind.  Will that make it easier to dismiss?   Issue is something like that may affect his CPA licensure since it involves a rigorous background check that includes IRS review and fingerprinting .  He is quite worried.

  If you refuse the breatalyzer the judge will be alot harder on him!  I was in court with a guy who did that and the judge maxed him out.  Refusal is like saying you are guilty but trying to hid it so there is no proof.  If he only had 2 beers, (which is what I told my cop and I actually had 8) and an energy drink, he would have been fine.  However, I find it hard to believe that is all he had and refused the test.  Just sayin.  He was probably smashed and knew he was fucked!
